Article 1 (Purpose)
The purpose of these Terms and Conditions is to set forth the rights, obligations, and duties between the Company and Users with respect to the use of internet-related services (hereinafter referred to as “Services”) provided by the cyber shopping mall Ultra Thai Koreans (hereinafter referred to as “Mall”) operated by SANGINIL ULTRASTYLE PRIVATE LIMITED (hereinafter referred to as “Company”).
Article 2 (Definitions)
“Mall” refers to the virtual business place established by the Company to facilitate transactions for goods or services using information communication facilities.
“Users” refers to members and non-members who access the Mall and receive Services provided by the Mall.
“Members” refers to persons who have registered their personal information with the Mall to continuously receive and use the Services.
Article 3 (Posting and Modification)
The Company shall post these Terms, the trade name, representative name, business address (West Bengal, India), email, and business registration numbers on the start-up screen for transparency.
The Company may modify these Terms to the extent that it does not violate relevant Indian laws, including the Information Technology Act, 2000 and Consumer Protection Act, 2019.
In the event of modification, the Company will post the changes at least seven (7) days prior to the effective date. For significant changes unfavorable to the user, a thirty (30) day notice period will apply.
Article 4 (Applicable Rules)
Any matter not provided in these Terms shall follow applicable laws of India, including consumer protection laws and standard commercial practices.
Article 5 (Provisions of Services)
The Company shall provide:
Information on goods/services and execution of purchase agreements.
Shipping of goods/services for which an agreement is entered.
Other services as determined by the Company.
Article 6 (Suspension of Services)
The Company may temporarily suspend Services for repairs, equipment failure, or communication breakage. In the event of permanent cessation of services (business conversion or merger), users will be notified via the methods in Article 8.
Article 7 (Membership Subscription)
Users apply by filling out the registration form and consenting to these Terms. Approval is finalized when the Company’s acceptance reaches the user.
Article 8 (Withdrawal and Disqualification)
Members may request withdrawal at any time.
The Company may restrict membership if a user registers false information, fails to pay for goods, or obstructs the operations of the Mall.
Article 9 (Notifications)
Notifications may be sent to the email address provided by the user. For general notifications, a notice on the Mall’s bulletin board for one (1) week shall suffice.
Article 10 (Purchase Application)
Users select goods, enter delivery details (name, address, phone), and select a payment method.
Article 11 (Formation of Agreement)
An agreement is formed when the Company’s receipt confirmation reaches the user. The Company may decline orders if there is false information or if the order is from a minor for restricted items.
Article 12 (Payment Methods)
Payments can be made via:
Online Banking / UPI / Account Transfers.
Credit, Debit, or Prepaid Cards.
Electronic Currencies/Points/Store Credit.
Cash on Delivery (if applicable).
Article 13 (Receipt Confirmation & Cancellation)
Users may request a change or cancellation immediately after receiving a receipt confirmation, provided the goods have not yet been shipped.
Article 14 (Shipping)
Unless otherwise agreed, the Company shall ship goods within seven (7) days of the order. The Mall will specify shipping means and costs.
Article 15 (Refunds)
If goods are sold out or unavailable, the Company shall notify the user immediately and process a refund within two (2) business days of receiving payment.
Article 16 (Withdrawal of Offers/Returns)
Users may withdraw an offer within 14 days of receiving the package (per the Return Policy).
Returns are not permitted if the product is opened, used, or damaged by the user.
Article 17 (Consequences of Withdrawal)
The Company shall refund the purchase amount within three (3) business days of receiving and inspecting returned goods. Return shipping costs are borne by the user unless the product is defective.
Article 18 (Personal Information Protection)
The Company collects minimum information (Name, Address, Phone, Email, IP) to process orders. Data is protected under the Company’s Privacy Policy and applicable Indian Data Protection laws.
Article 19 (Duties of the Company)
The Company shall not engage in prohibited activities and shall use its best efforts to provide secure and continuous service.
Article 20 (Member Duties for ID/Password)
Members are responsible for maintaining the confidentiality of their IDs and passwords and must notify the Company if their account is compromised.
Article 21 (Duties of Users)
Users shall not misappropriate information, change Mall content, or post obscene/violent messages on the platform.
Article 22 (Copyright)
All intellectual property prepared by the Company belongs to the Company.
Users shall not duplicate or distribute Mall content for profitable purposes without prior permission.
Article 23 (Dispute Resolution)
The Company will operate a customer service department to handle complaints. Priority is given to resolving issues promptly and fairly.
Article 24 (Jurisdiction and Governing Laws)
Any legal action regarding transactions between the Company and the User shall be governed by the laws of India.
The competent court for any disputes shall be located in West Bengal, India.
